Burnet County Declines Prosecution on Evading Arrest Case – December 2012
After a two-year ordeal, a young Burnet County mother learned today that the Burnet County District Attorney’s office had declined prosecution of pending charges against her of felony evading arrest and child endangerment.
“This nice lady’s long ordeal is finally over,” said her lawyer, Bob Phillips. “There was real question about whether, due to a chemical imbalance she suffered from on the day in question, coupled with an imbalance in the medications she was taking, my client had the requisite mental state to be held criminally responsible for her actions. Thankfully, no one was injured in the car chase, and after a thorough psychiatric and investigative review of the case, the Burnet County District Attorney’s office is satisfied that charges should be dropped. We are most grateful for the result, obviously, and are confident that this woman can now move on with her life, with no stigma of a felony criminal record.”
